Welcome to Dental Marketing Lab (“DML,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, audits, reports, and any related products or communications (collectively, the “Services”).
By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
1. Who We Are
Dental Marketing Lab provides marketing consulting and strategy services for dental practices and dental service organizations (DSOs). Our offerings include—but are not limited to—fractional CMO services, practice growth programs, and marketing audits (such as the “Lab Report”).
2. Use of Our Services
You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:
Copy, distribute, or resell any DML materials without written consent.
Misrepresent your identity or relationship with DML.
Use our Services to transmit spam, malware, or unlawful content.
Attempt to gain unauthorized access to our systems or data.
We reserve the right to suspend or terminate access to anyone who violates these Terms.
3. Intellectual Property
All content, materials, and intellectual property provided by DML—including our website content, branding, templates, audit reports, recommendations, and design assets—are owned by Dental Marketing Lab and protected by copyright and trademark law.
You are granted a limited, non-exclusive, non-transferable license to use deliverables created specifically for your business. Reuse, resale, or redistribution without written permission is prohibited.
4. Confidentiality
We treat all client information and data shared with DML as confidential. Likewise, you agree not to disclose, distribute, or reproduce any proprietary frameworks, templates, or materials provided by DML without permission.
5. Payment and Refunds
Payments for consulting services, audits, or recurring retainers are due as agreed in your service proposal or invoice.
All payments are non-refundable once Services have begun.
Late payments may result in paused work or termination of Services.
DML reserves the right to adjust pricing with reasonable notice for ongoing engagements.
6. No Guarantees
While DML provides marketing strategy and recommendations designed to improve visibility, new patient flow, and ROI, results may vary based on implementation, market conditions, and other factors outside our control. DML does not guarantee specific business outcomes or performance results.
7. Limitation of Liability
To the maximum extent permitted by law, DML shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the use or inability to use our Services.
Our total liability for any claim shall not exceed the amount you paid to DML for the Services in question.
8. Third-Party Tools and Links
Our Services may reference or integrate with third-party platforms (such as Google, Meta, SEMrush, etc.). We are not responsible for the performance, terms, or data practices of those third parties. You agree to comply with their individual terms of use where applicable.
9. Termination
Either party may terminate a service agreement with written notice per the terms of your contract. Upon termination, all outstanding balances become due, and DML retains ownership of any unpaid creative or strategy materials.

11. Changes to Terms
We may update these Terms periodically. The most recent version will always be posted on our website with the updated effective date. Continued use of our Services after any update means you accept the revised Terms.
